Privacy Policy
This Privacy Policy explains how SparkUp (“SparkUp”, “Service”, “Application”, “we”, “our”, or “us”) collects, uses, processes, stores, shares, and protects users’ personal data.
By using the Application, you acknowledge that you have read this Privacy Policy.
1. Information We Collect
Depending on the features used, SparkUp collects and processes the following categories of data.
Information Provided by the User:
- profile name;
- photographs;
- age;
- gender;
- the gender of users the user is looking for;
- selected dating preferences and dating purpose;
- text messages and photographs sent within chats in the Application;
- selected filters and search settings.
Geolocation Data
- the user’s approximate or precise location, if location access is permitted in the device settings;
- the distance between profiles, calculated based on users’ locations;
- the distance to a profile, stored at the time of interaction with that profile.
Application Usage Data
- “Like” and “Dislike” actions;
- interactions with profiles;
- matches;
- actions within the Application;
- information about completion of the registration process;
- information about the use of individual features;
- interactions with subscription screens and special offers;
- actions related to initiating, completing, or restoring a purchase.
Data Used for Personalisation and AI Group Ranking
To calculate personalised preferences, SparkUp processes:
- the technical identifier of the profile with which the user interacted;
- the type of action: “Like” or “Dislike”;
- the age of the user associated with the relevant profile;
- the distance to the relevant profile at the time of interaction;
- the specified Looking For category or categories;
- calculated numerical preference weights for age, distance, and Looking For categories;
- the profile match percentage calculated for the specific user.
Detailed information about the processing of this data is provided in the section on personalised group ranking and profile display.
Technical and Analytical Information
SparkUp and the third-party technical services it uses may automatically process:
- technical information about the device;
- the operating system version;
- the Application version;
- language, region, and time zone;
- technical identifiers of the user profile, Application instance, or device;
- IP address, if its processing is not disabled in the settings of the relevant third-party service;
- analytical and technical events related to the operation and use of the Application.
Subscription and Purchase Information
- information about purchased subscriptions and message packages;
- displayed subscription offers;
- the selected product, package, or plan;
- subscription status;
- purchase information;
- information about the initiation, completion, failure, or restoration of a purchase;
- information about the renewal, cancellation, or refund of a purchase;
- interactions with subscription screens and offers within the Application.
All payments are processed through the Apple App Store. SparkUp does not receive or store the user’s full payment card details.
2. Geolocation
SparkUp uses approximate or precise location data to display nearby users, generate recommendations, determine the distance between profiles, and provide locally relevant dating results.
Access to location data is granted through the device’s system permissions. The user may restrict or disable location access at any time in the device settings. After location access is disabled, certain SparkUp features may operate with limited functionality or become unavailable.
For profiles with which the user has interacted, SparkUp stores the distance calculated at the time of the relevant interaction. The stored distance is not automatically updated if the users subsequently change their locations. SparkUp does not continuously track users’ locations after such an interaction.
Precise coordinates are not displayed to other users. The Application may display only an approximate location and the distance calculated between profiles.
3. Messages and Communication
Users may send text messages and photographs to each other within the Application.
Text messages and photographs exchanged between users are stored and processed for:
- providing communication features;
- delivering and displaying messages and photographs;
- maintaining chat history;
- handling complaints;
- preventing fraud, spam, and abuse;
- protecting users and the platform.
SparkUp does not use users’ private messages or photographs sent within chats for third-party advertising and does not sell such content to advertising companies.
Users may delete a chat directly within the Application. After deletion is confirmed, the entire chat history, including all text messages and photographs exchanged within that chat, is permanently deleted for both participants and from SparkUp’s servers. Deleted messages and photographs are no longer accessible to either participant, and SparkUp does not retain a copy of the deleted chat or its contents.
4. Personalised Group Ranking and Profile Display
SparkUp uses personalised group ranking — AI Group Ranking — to show users profiles that most closely match their previous “Like” and “Dislike” actions.
Initial Preference Calculation
After registration, the first profiles are displayed without applying personalised preference weights.
Before any personal data is transmitted to OpenAI for the first time, SparkUp clearly informs the user that the data will be shared with OpenAI, identifies the categories of data to be transmitted and the purpose of the transfer, and obtains the user’s explicit permission.
After the user marks the first 10 displayed profiles as “Like” or “Dislike,” SparkUp transmits data about these interactions through the OpenAI API for the initial calculation of personalized preference weights.
For each profile with which the user interacted, only the following data is transmitted:
- the profile’s technical identifier;
- the action type: “Like” or “Dislike”;
- the age of the user associated with the relevant profile;
- the distance to the relevant profile at the time of the interaction;
- the specified Looking For category or categories:
- Flirt;
- Dating;
- Relationship;
- Friendship First;
- Conversation First;
- Coffee Date.
OpenAI mathematically calculates numerical preference weights from 0 to 1 for SparkUp separately for each Looking For category, each age range, and each distance range. The calculation is performed based on the ratio of “Like” and “Dislike” actions, taking into account the number of signals received, after which the completed set of weights is transmitted to SparkUp.
The resulting weights are stored on SparkUp’s servers and used for the following three days. SparkUp combines these weights and uses them to identify the most suitable accounts for display.
Preference Updates
After the initial calculation, the personalised weights are updated every three days.
For each new calculation, SparkUp transmits through the OpenAI API data about profiles that the user marked as “Like” or “Dislike” during the immediately preceding three days.
OpenAI calculates a new set of weights, which replaces the previous set and is used for the following three days.
Therefore:
- the first set of weights is calculated after the user’s first 10 actions;
- each subsequent set is calculated based on the user’s actions during the previous three days.
Use and Storage of Data
OpenAI receives only the data listed in this section.
OpenAI does not receive:
- names;
- photographs;
- profile descriptions;
- private messages;
- precise coordinates;
- the full list of available profiles;
- information about profiles with which the user has not interacted.
OpenAI does not select profiles for display, does not receive the current list of available profiles, does not calculate the final match percentage, and does not determine the order in which profiles are displayed.
After completing the calculation, OpenAI returns to SparkUp only the calculated numerical preference weights.
After each new calculation, the previous set of weights is replaced by the new set.
After receiving the calculated weights, SparkUp independently uses them to filter, evaluate, and rank available profiles in order to show the user the most suitable accounts.
After the calculated weights are returned to SparkUp, OpenAI is not involved in the subsequent selection, evaluation, ranking, or display of profiles.
Data transmitted through the OpenAI API is not used to train or improve OpenAI models by default unless SparkUp expressly opts in to such use. OpenAI may process and technically retain API data in accordance with its applicable terms, endpoint settings, security requirements, and data retention controls.
Profile Selection and Ranking
Each time the user requires a new group of profiles, SparkUp obtains the current list of profiles that:
- most closely match the user’s mandatory search criteria;
- are available for display at that time;
- have not yet been marked as “Like” or “Dislike” by that user.
In this way, SparkUp personalises the accounts displayed to the user.
The list of available profiles is dynamic and may change due to the appearance of new profiles, changes in users’ locations or settings, account deletion or deactivation, blocks, and other changes in availability.
SparkUp independently applies the personalised weights to each suitable profile and calculates the match percentage based on a combination of the following data:
- the Looking For category or categories;
- the age of the user associated with the profile;
- the distance to the profile.
The calculated percentage is displayed on the profile page and reflects the degree to which the profile matches the preferences of the specific user, as determined based on the user’s previous “Like” and “Dislike” actions.
From the current list, SparkUp selects up to 10 profiles with the highest match percentage and randomly shuffles them within the group.
Therefore, profiles are not displayed in strict descending order of percentage: the profile with the highest result may appear in any position within the group.
After the current group has been completed, the next group is not taken from a previously saved list. SparkUp retrieves the current available profiles again, excludes profiles that have already been viewed, calculates their match levels, and forms a new group of up to 10 profiles.
5. Push Notifications
SparkUp may send push notifications about:
- new messages;
- matches;
- received “Likes”;
- changes to features or the operation of the Service;
- important notifications related to security or the account.
Push notifications are sent only with the user’s permission.
The user may disable or change notification settings in the device settings.
6. Third-Party Services and Data Sharing
SparkUp does not sell users’ personal data or share it with third parties for their independent use for advertising purposes.
To operate the Application, perform analytics, manage subscriptions, personalise features, and improve the Service, SparkUp uses third-party technical services.
Google Analytics for Firebase
Google Analytics for Firebase is used to analyse registration, user activity, the use of Application features, interactions with subscription screens, and the operational stability of SparkUp.
The service may process technical information, Application or device identifiers, data about activity within the Application, and user properties, including age, gender, dating preferences, and the selected dating purpose.
This information is used to analyse the audience, evaluate feature performance, identify technical issues, and improve the Service.
Adapty
Adapty is used to display and manage subscription offers, determine purchase status, segment users, conduct A/B tests, and analyse the performance of paid features.
Adapty may process technical identifiers, user properties, information about interactions with subscription screens, selected offers, purchases, and subscription status.
This information is used to display relevant offers, manage access to paid features, verify and restore purchases, conduct A/B tests, and analyse subscriptions.
OpenAI API
SparkUp uses the OpenAI API to calculate personalised preference parameters as part of the AI Group Ranking feature.
Only the limited set of data described in the section on personalised group ranking is transmitted through the OpenAI API. SparkUp does not use the OpenAI API to select specific profiles, calculate the final match percentage, or determine the order in which profiles are displayed.
After receiving the calculated parameters, SparkUp independently applies them to evaluate and rank available profiles.
Apple App Store
All payments and subscriptions are processed through the Apple App Store in accordance with Apple’s terms and policies.
SparkUp receives only the information necessary to determine the status of a purchase or subscription, restore purchases, and provide the user with the corresponding paid features.
Data may also be shared with technical service providers that support the operation and security of the Service, as well as with government authorities, courts, or law enforcement agencies when such disclosure is required by applicable law or a legally binding request.
Only the categories of data necessary to perform the relevant functions are shared with third-party service providers.
SparkUp requires third-party service providers that process personal data on its behalf to protect such data in accordance with applicable law and to provide a level of protection consistent with this Privacy Policy.
7. Purposes of Data Use
SparkUp uses the collected data for:
- creating and maintaining the user’s account;
- displaying and managing the user’s profile;
- finding and displaying suitable profiles;
- providing dating and communication features;
- determining the distance between users;
- processing “Likes,” matches, text messages, and photographs exchanged within chats;
- providing subscriptions and paid features;
- verifying purchase status;
- sending authorised notifications;
- analysing usage and improving the operation of the Application;
- detecting errors and technical issues;
- preventing fraud, spam, and abuse;
- handling complaints and violations;
- protecting users;
- complying with legal obligations.
SparkUp does not use personal data for purposes that are incompatible with this Privacy Policy.
8. Data Security
SparkUp implements appropriate organisational and technical measures designed to protect users’ personal data against:
- unauthorised access;
- unlawful use;
- accidental loss;
- alteration;
- disclosure;
- destruction.
The security measures are determined with consideration of the nature and scope of the data processed, the purposes of the processing, and the potential risks to users.
Access to personal data is limited to authorised persons and service providers only to the extent necessary to perform the relevant functions.
Despite the measures taken, no method of data storage or transmission over the internet can guarantee absolute security.
9. Data Retention
Users’ personal data is stored on SparkUp’s servers only for as long as the user’s account exists and the data is required to provide the Service.
Once account deletion is confirmed, all personal data under SparkUp’s control is permanently and irreversibly deleted from SparkUp’s servers. SparkUp does not anonymise, archive, retain backup copies of, or continue to use deleted data. The deleted account and associated data cannot be restored.
SparkUp also submits a request to delete the user’s associated profile and data from Adapty.
Information independently retained by Apple in connection with App Store purchases and subscriptions is governed by Apple’s own terms, privacy policies, and legal obligations and is outside SparkUp’s control.
10. Account and Data Deletion
Users may initiate the deletion of their account directly within the Application.
Deleting the Application from the device does not automatically delete the user’s SparkUp account.
Once account deletion is confirmed, SparkUp deletes the account and all associated personal data under its control as described in Section 9.
Deleting a SparkUp account does not cancel an active auto-renewable subscription purchased through the Apple App Store. The user must manage or cancel the subscription separately through their Apple Account settings. The subscription may continue to renew through Apple until it is cancelled or otherwise expires.
If the user cancels the subscription, access to paid features remains available until the end of the current paid subscription period and then ends.
11. User Rights and Settings
All users may:
- delete their account and associated personal data directly within the Application;
- withdraw consent where the processing of personal data is based on consent;
- restrict or disable access to location data;
- disable push notifications;
- submit a question or complaint regarding the processing of personal data.
Depending on applicable law, users may also have the right to:
- request information about their personal data;
- request the correction of inaccurate personal data.
Location and notification permissions can be changed in the device settings.
Requests concerning personal data may be submitted to: support@sparkup.work.
Restricting access or withdrawing certain permissions may affect the availability or operation of some SparkUp features.
12. Age Restrictions
SparkUp is intended exclusively for users who are 18 years of age or older.
Persons under the age of 18 are prohibited from creating an account or using the Service.
If SparkUp becomes aware that an account belongs to a person under the age of 18, the account and all associated personal data under SparkUp’s control will be deleted.
13. Changes to This Privacy Policy
SparkUp may periodically update this Privacy Policy in connection with changes to:
- the features of the Application;
- the methods used to collect, use, or share personal data;
- the technical and third-party services used;
- applicable laws;
- the requirements of application distribution platforms.
If any changes materially affect how personal data is processed, SparkUp will notify users within the Application or by another appropriate method before such changes take effect, where required by applicable law.
If a new method of data processing requires the user’s consent, SparkUp will obtain such consent before beginning the relevant processing.
The current version of this Privacy Policy is always available within the Application or on the SparkUp website.
The effective date stated at the beginning of this document indicates the date on which the current version of this Privacy Policy took effect.
