Terms of Use

These Terms of Use (“Terms”) govern your use of the SparkUp mobile application (“SparkUp”, “Service”, “Application”, “we”, “our”, or “us”). By using SparkUp, you confirm that you have read, understood, and agreed to these Terms.

1. General Provisions

SparkUp is a dating and communication application designed for meeting new people.

SparkUp is operated by the copyright holder of the Service. The applicable jurisdiction is the Republic of Armenia.

Use of the Application is permitted only upon acceptance of these Terms and the Privacy Policy. If you do not agree with these Terms, you must stop using the Service.

2. Age Restrictions

SparkUp is intended exclusively for users aged 18 years or older. By creating an account, you confirm that you are at least 18 years old. Use of the Application by minors is strictly prohibited.

3. User Account

Registration is available through Apple ID. Users agree to provide accurate information and are responsible for their photos, profile information, messages, and activities within the Application.

SparkUp reserves the right to restrict, suspend, or remove accounts in cases of violations of these Terms, suspicious activity, complaints from other users, fraud, spam, abuse, or prohibited content.

4. Community Rules

Users agree not to:

• use the Service for illegal purposes;
• impersonate another person;
• use stolen or misleading photos;
• publish offensive, illegal, misleading, or prohibited content;
• distribute spam;
• engage in fraud;
• use the Service for unauthorized advertising, commercial services, or escort services;
• harass, threaten, or abuse other users;
• publish sexually explicit content that violates applicable App Store requirements.

5. Moderation and Safety

SparkUp may use automated and manual moderation methods and may remove content, restrict account functionality, temporarily suspend accounts, or permanently remove accounts where necessary to enforce these Terms or protect users and the Service.

Users may report inappropriate content or behavior and block other users through the features available within the Application.

While SparkUp takes reasonable measures to promote safety, SparkUp does not guarantee the identity, intentions, conduct, or authenticity of every user. Users are responsible for exercising appropriate judgment when communicating with or meeting other users.

6. Subscriptions and Digital Purchases

SparkUp may offer Premium subscriptions and message packs. Purchases and subscriptions are processed through the Apple App Store. Applicable prices, subscription periods, features, and purchase conditions are displayed within the Application before purchase.

Auto-renewable subscriptions may renew automatically in accordance with the applicable Apple App Store terms unless cancelled by the user. Users can manage or cancel subscriptions through their Apple Account settings.

Deleting the Application or a SparkUp account does not automatically cancel an active subscription.

7. Message Packs

Free users may receive a limited number of messages for starting conversations. Once the applicable limit is reached, users may purchase additional message packs within the Application.

Message packs are digital features available only within SparkUp, have no monetary value, cannot be transferred or exchanged, and are non-refundable except where required by applicable law or Apple policies.

8. Personalized Recommendations and Ranking

SparkUp may use automated and AI-assisted systems to personalize profile recommendations and ranking based on user preferences and interactions within the Application.

Personalized recommendations and match results are intended to assist profile discovery and do not guarantee compatibility, communication, a match, or any particular outcome.

Information about the processing of personal data in connection with personalized ranking and related features is provided in the Privacy Policy.

9. User Content

Users retain ownership of the content they provide through SparkUp. By providing content, users grant SparkUp a non-exclusive right to store, process, display, and otherwise use that content only as necessary to operate, provide, moderate, and protect the Service.

Users must own or have the necessary rights and permissions to provide content through the Application and must not infringe the rights of others.

10. Limitation of Liability

SparkUp is provided “as is”. To the maximum extent permitted by applicable law, SparkUp does not guarantee uninterrupted or error-free operation, compatibility with every device, the authenticity or conduct of other users, or successful dating, matching, communication, or other outcomes.

To the maximum extent permitted by applicable law, SparkUp is not responsible for the conduct of users, communications between users, or meetings arranged through the Service, except where liability cannot legally be excluded or limited.

11. Account Deletion

Users may initiate deletion of their account directly within the Application.

Once account deletion is confirmed, SparkUp deletes the account and associated personal data under its control in accordance with the Privacy Policy.

Deleting the Application from the device does not automatically delete the user’s SparkUp account.

Deleting a SparkUp account does not automatically cancel an active auto-renewable subscription purchased through the Apple App Store. Users must manage or cancel their subscription separately through their Apple Account settings.

12. Changes to the Terms

SparkUp may update these Terms from time to time to reflect changes to the Service, applicable requirements, or other relevant circumstances.

The current version of these Terms will be available within the Application or on the SparkUp website. Where required by applicable law, users will be notified of material changes or asked to provide any required consent.
